Common Questions

Frequently asked questions

How much notice must a landlord give in Wisconsin?

It depends on the tenancy (Wis. Stat. s. 704.17): at least 5 days for nonpayment on a month-to-month tenancy, with a right to pay and stay (s. 704.17(1p)(a)); at least 14 days with no right to cure for a second default within 12 months (s. 704.17(2)(a)); and at least 30 days for a lease longer than one year, with the full period to pay (s. 704.17(3)(a)).

Can a landlord change the locks or remove my belongings?

No. Removal runs through a court judgment and a writ of restitution executed by the county sheriff. A landlord who changes locks, removes belongings or cuts services is acting outside that process.

How does an eviction case proceed?

An eviction is a civil action of eviction commenced under Wis. Stat. s. 799.40(1) and heard in circuit court. If the landlord prevails, the court enters judgment for restitution of the premises and orders a writ of restitution (s. 799.44(1)–(2)).

What is a writ of restitution?

The court order issued after an eviction judgment directing the county sheriff to remove the tenant and restore possession to the landlord (Wis. Stat. s. 799.44(4)).

Do you represent landlords as well as tenants?

Yes. Attorney Vargas represents both landlords and tenants.
