Frequently asked questions

How long does a divorce take in Wisconsin?

At minimum 120 days. Under Wis. Stat. s. 767.335, a divorce or legal separation cannot reach final hearing until 120 days after the summons and petition are served, or after a joint petition is filed. The court may order an earlier hearing in emergency circumstances affecting health or safety. Contested matters take longer.

What is the difference between legal custody and physical placement?

Legal custody is who makes major decisions for a child. Physical placement is where the child spends time. They are decided separately, and clarifying which is genuinely in dispute usually narrows the case.

Do we have to attend mediation?

Where legal custody or physical placement is contested, the court refers the parties to family court services and they must attend at least one session (Wis. Stat. s. 767.405). The court may waive that where attending would cause undue hardship or endanger the health or safety of a party.

What happens during the 120-day period?

It is rarely idle time. Temporary orders, placement schedules and financial disclosure are typically worked out during it, and cases that use the period well tend to finish faster once it expires.
